1. Contact and scope
Operator: Heather Kruger, trading as Upper Highway Hub
Email: info@upperhighwayhub.co.za
Telephone: 073 851 0390
Physical address and address for legal notices: 10 Helier Road, Gillitts, 3610, KZN
This policy applies to payments to Upper Highway Hub for our listing services. Refunds for products, services or event tickets purchased directly from another business or organiser must be discussed with that seller.
2. Cancel at any time
You may cancel future monthly renewals at any time. There is no cancellation fee and no requirement to give a reason.
Email info@upperhighwayhub.co.za from your account email address with your business name and a request to cancel. We may take reasonable steps to verify the request. You can also telephone us for assistance, but email provides a clear record.
A clear cancellation notice takes effect when received; our acknowledgement does not change its receipt date. We will stop future renewals and confirm the final service date. If a charge is taken after cancellation took effect, we will refund it in full.
Your paid listing remains available until the end of the period already paid for, unless you request immediate removal. Simply choosing not to renew does not normally refund a correctly supplied current period, subject to the rights and promises below.
Deleting a listing or your website account does not itself cancel a payment agreement. Please explicitly cancel your subscription and retain our confirmation. If confirmation has not arrived within two business days, contact us again so we can check it.
3. Seven-day first-payment satisfaction promise
If your first paid listing is not right for you, request a refund within seven calendar days after its first publication. We will refund the first listing payment in full, cancel future renewals and end the paid listing service.
This voluntary promise applies to the first payment only, not to each monthly renewal. You do not need to prove a service fault. It does not replace or shorten any statutory cancellation or refund right.
4. Rejected or unpublished paid listings
If we reject your paid listing before publication, we will refund the listing payment in full and cancel future charges.
If you cancel before the paid listing is first published, we will refund your first payment in full and cancel future charges. If publication is materially delayed, contact us; we will agree a fair solution and will not require you to accept a service credit instead of an applicable refund.
5. Errors and service failures
- Duplicate or incorrect charges: we refund the incorrect amount in full.
- Charges after effective cancellation: we refund those charges in full.
- Material failure to supply purchased services: we provide the remedy required by applicable law, including an appropriate partial or full refund having regard to the extent of the failure.
We welcome the chance to resolve a problem, but you do not have to accept repeated repair attempts or a credit in place of a refund you are entitled to. For refunds due to our error, we do not deduct payment processing fees from the amount due to you.
6. Enquiries and sales results
We provide listing visibility and the features stated in the purchased package. We cannot guarantee a number of views, enquiries, bookings or sales. A lower-than-hoped response alone does not normally qualify for a refund after the satisfaction period where the purchased service was correctly delivered. This does not excuse misleading promises or failure to deliver purchased features.
7. Statutory cooling-off and consumer rights
Where section 44 of South Africa’s Electronic Communications and Transactions Act applies, a consumer may cancel an online service agreement without reason or penalty within seven days after the agreement is concluded, and applicable refunds must be made within 30 days of cancellation.
The Act contains exceptions, including services begun with the consumer’s consent before the seven-day period ends. We will assess any exception on the actual facts; publication alone is not treated as automatic proof of consent to an exception.
Applicable rights under the Consumer Protection Act and other law remain available, including remedies for deficient services. Our satisfaction promise is additional to those rights.
8. Requesting and receiving a refund
Email your listing name, account email, invoice or payment reference, and the reason for the request unless you are using the no-reason satisfaction promise. Do not send card numbers, passwords or bank login details.
We aim to acknowledge requests within two business days and give a decision or meaningful update within five business days. Once agreed, we aim to initiate refunds within seven business days, subject to any shorter legal deadline. Bank and payment provider processing can affect when funds appear.
Refunds are normally returned through the original payment method. If that is not possible, we will agree a secure alternative and verify the recipient. We will not charge an administrative refund fee.
9. Free introductory listings
Where offered, the free introduction lasts one calendar month from first publication. No payment is taken and it does not automatically convert to a paid subscription. You must actively choose and authorise a paid package to continue. A different introductory period already expressly promised will be honoured.
10. Unresolved concerns
If you remain unhappy, ask Heather Kruger to review the matter using the contact details above. This does not restrict your right to approach your payment provider, the National Consumer Commission at thencc.org.za, or another competent authority.
